MDC's application dismissed |

The High Court has dismissed an application by the MDC faction led by Professor Arthur Mutambara and others who were challenging the validity of the congress that ushered in Professor Welshman Ncube as the party’s leader.
The application was filed by the MDC Mutambara faction’s National Chairperson, Mr. Joubert Mudzumwe.
In his judgement, Justice Bharat Patel said the 3rd national congress of the MDC held in January last year, was conducted within the legal parameters of the constitution of the MDC.
Justice Patel said the first applicant cannot rely on his absence to argue that all the proceedings at the congress were a nullity because he was not present in person to chair the proceedings.
The other faction of the MDC-led by Professor Welshman Ncube’s Secretary General, Mrs. Priscilla Misihairabwi-Mushonga welcomed the judgement which she hailed as fair.
Meanwhile, the Mutambara faction represented by Mr. Aleck Muchadehama has indicated that they are going to appeal against the judgement saying the judge misdirected himself in arriving at his conclusion.
Mr. Muchadehama indicated that he is going to file a notice of appeal.
