In handing over his judgement, Provincial Magistrate Mr Billiard Musakwa said the state managed to prove beyond any reasonable doubt that Newman Chiadzwa was found in possession of the diamonds and that he was also dealing in the precious stones illegally.

It is the state case that on the 14th of October 2006, detectives from the minerals unit headquarters visited Newman’s business premises after receiving reports that he was exchanging diamonds for shop goods.

They searched him and found 177 grammes from his shirt and later found 10 kilogrames of diamonds in the boot of his vehicle.

In his mitigation submission, the Defence Lawyer Mr Chris Ndlovu urged the court to impose a lenient sentence since Chiadzwa is a first time offender, a businessman of substance who has contributed immensely to the development of the Chiadzwa community.

Chiadzwa will remain in custody awaiting his sentence next month and the state is expected to make aggravation submissions before sentence.
