A legal expert says the move to recall Professor Arthur Mutambara from his Deputy Prime Ministerial post by the Welshman Ncube led faction in the MDC formation should be understood in the context that the Head of State and Government and Commander- in-Chief of the Zimbabwe Defence Forces, Cde Robert Mugabe has the final say in the matter.
Advocate Ashton Musunga has issued a warning to the MDC in face of the announced recall of Professor Arthur Mutambara from the post of Deputy Primier.
In an interview with ZBC News, Advocate Musunga said there is need for the MDC to realise that while it cannot be legally challenged in its internal matters, the recall of Professor Mutambara will be directed by President Mugabe, who has the sole discretion to accept or reject the move.
â€œAs far as the Mutambara recall is concerned, the new MDC leader, Professor Welshman Ncube can only make legal recommendations and it is up to the President to accept or reject them.
â€œThe DPMâ€™s post created in the context of the Global Political Agreement is a government matter, hence the President of this country has the final say in the matter,â€ Advocate Musunga said.
The MDC over the weekend announced the demotion of Professor Arthur Mutambara from the DPMâ€™s post with a move to reassign him in the Regional Integration and International Co-operation Ministry held by the partyâ€™s new Secretary General, Priscilla Misihairabwi-Mushonga.
Professor Mutambara is yet to respond publicly to the planned dethronement although sources within the feuding faction say he refused the offer.
