Former Zanu PF youth leader and politician William Mutumanje also known as Acie Lumumba has formerly withdrawn his Constitutional Court application challenging the validity of Section 32 subsection ( 2) b of the Criminal Law Codification and Reform Act chapter 9:23 which deals with the charge of undermining the authority of the president.
His withdrawal of the matter was prompted by the state developing cold feet and notifying the court of its intention to withdraw the charges against Lumumba at the Magistrates Court.
Edmore Nyazamba from the National Prosecuting Authority notified the court that their decision was influenced by the Mwonzora matter whose ruling deemed the crime of undermining the authority of the president as unconstitutional.
He took an undertaking that by the 12th of June at Lumumba’s scheduled routine remand hearing at Harare Magistrates Court, the state will have formally withdrawn charges against him.
Chief Justice Luke Malaba ruled that by consent the matter be removed from the roll for the reason that it has been withdrawn and there shall be no order as to costs.
