mutambara-ncube.jpgProfessor Arthur Mutambara has lost his legal battle with Professor Welshman Ncube over the control of the MDC.

In a judgment handed over by Justice Nicholas Mathonsi, Justice Lawrence Kamocha barred Professor Mutambara from conducting any business on behalf of MDC or to present himself as president or principal of the party.

The MDC led by Professor Welshman Ncube was seeking confirmation of a provisional order barring Professor Arthur Mutambara from presenting himself as president of MDC and to stop representing MDC in the Global Political Agreement.

The legal battle between Professor Ncube and Professor Mutambara started in January this year at the MDC congress in Harare where Professor Mutambara challenged the election of Professor Ncube as president.

Professor Mutambara, together with 13 others, allegedly contested the legitimacy of the party structures which emerged from the congress elections.

Meanwhile, Professor Arthur Mutambara says the judgement does not affect his position as both the Deputy Prime Minister and Principal, indicating that he will however appeal against the High Court decision.
