court.jpgThe case of Hwange Colliery Company has taken a new twist at the Hgh Court with the applicants seeking to withdraw their application.

The application was seeking the court to determine the legality of the Hwange Colliery Annual General Meeting.

The applicants represented by Mr. Gerald Mlotshwa intended to withdraw their application saying the two parties, the government and the applicant wanted to have an out of court settlement.

However, Mr. Simplicious Chihambakwe who was representing the Minister of Mines and Mining Development, Cde Obert Mpofu argued that he was not aware of such developments.

The parties have agreed to adjourn the matter to tomorrow (Friday) to enable them to seek further instructions from their clients.

On Monday the applicants representing the current Hwange Colliery Company board led by Mr. Tendai Savanhu, filed an urgent chamber application seeking the court to determine the legality of the company’s proposed AGM which was slotted for Wednesday this week.

 

However, the meeting went on and it was said to be a shareholders meeting not an annual general meeting.
