Chitungwiza Town Clerk, Godfrey Tanyanyiwa is now out of custody after the state failed to challenge the magistrateâ€™s decision to grant him bail.
Tanyanyiwa, who is facing charges of defrauding Chitungwiza Town Council, was granted US$1 000 bail by a Harare magistrate.
However, the state revoked the bail in terms of Section 121 of the Criminal Procedure and Evidence Act.
The act provides that the state can revoke bail and appeal to the High Court against the magistrate decision to grant bail.
However, the state did not appeal within the seven days as provided by the law.
Meanwhile, Fungai Mbetsa has been appointed Chitungwiza Acting Town Clerk since Tanyanyiwa is still on suspension.
