A Harare magistrate has slapped Chantelle Muteswa, the former girlfriend to South African-based business tycoon, Frank Buyanga to one-month imprisonment and fined her RTGS $20 for contempt of court.

The Magistrate, Mr Noah Gwatidzo however, wholly suspended the jail term on condition that Muteswa purges her contempt of court charges by complying with the court order.

Further, he ruled that the order shall act as a warrant of arrest and detention should she persist in undermining court orders.

Magistrate Gwatidzo found Muteswa guilty of contempt of court charges stemming from her refusal to surrender her minor son’s passport to Buyanga whenever he intends to travel with him outside the country in enjoyment of his unsupervised access rights.

Buyanga had dragged Muteswa to court pleading with the court to compel her to comply with the order to surrender the passport on all of his access days in accordance with the custody order handed down by the civil court on the 17th of April 2019.

Muteswa through her lawyer had strongly resisted the charge on the basis that she had lodged an appeal subsequent to the order, thereby suspending the order by the lower court.

The court said even if she genuinely believed that the order was irregularly issued, she still had an obligation to comply with it and seek redress afterwards rather than undermining the authority of the court.
