A 23 year old Lupane man, Paulos Ndlovu is being accused of raping his 11 year old niece and neighbour who is a grade five pupil at Tshebetshebe Primary School in the district.

The rape cases took place between the 1st and 28th of February this year at Tshebetshebe village under Chief Mabhikwa in Lupane.

In one of the incidents, it is alleged the girl was sent by her aunt Thandolwenkosi Ndlovu to go to the garden to fetch vegetables.

While in the garden, the accused approached the complainant and requested to have sexual intercourse with her and she refused.

The accused then drew closer, grabbed her hands and felled her to the ground.

However, after a delayed return of the girl, her aunt followed her and found the accused on top of the complainant.

Upon noticing her, the accused quickly dressed and ran away, then she explained to her aunt what had happened.
The complainant was medically examined at St Lukes Hospital in Lupane.

Meanwhile, the defence has requested that if the state intend to produce exhibit, he should be given the papers three days before the trial date.

The trial continues at the Hwange Magistrates Court on Monday.

According to the law, an 11 year old is incapable of consenting to sexual intercourse and unable to understand the nature and possible consequences of the conduct to give informed consenting to sexual intercourse and unable to understand the nature and possible consequences of the conduct to give informed consent.
